Article 2 These Measures apply to the management of the recycling of new energy automotive power storage batteries (hereinafter referred to as power storage batteries) within the territory of the People's Republic of China (excluding Taiwan, Hong Kong, and Macao).
Article 3 Waste power batteries generated in the course of production, use, utilization, storage, and transportation shall be recycled in accordance with this method.
Article 4 The Ministry of Industry and Information Technology shall, together with the Ministry of Science and Technology, the Ministry of Environmental Protection, the Ministry of Transport, the Ministry of Commerce, the General Administration of Quality Supervision, Inspection and Quarantine, and the Energy Administration, manage and supervise the recovery and utilization of power storage batteries within their respective areas of responsibility.

Second, design, production and recycling responsibilities
Article 7 Power battery production enterprises shall adopt standardized, versatile and easily disassembled product structure designs, and negotiate the opening of power battery control system interfaces and communication protocols and other information that is conducive to recycling, and detachable and easy to install the power battery fixed parts. Recycling design. Material harmful substances should meet the requirements of relevant national standards and use recycled materials as much as possible. Article 8 Battery production enterprises shall promptly provide technical information such as battery dismantling and storage to automobile production enterprises, and provide technical training if necessary. Automobile production enterprises shall comply with the relevant provisions of the national new energy automobile production enterprises and product entry management and compulsory product certification, and voluntarily disclose the technical information instructions for disassembling, disassembling and storing power batteries, and the types and contents of toxic and hazardous components of power batteries. , recycling measures and other information.
Article 9 A battery manufacturing enterprise shall coordinate with an automobile production enterprise and code the production of the power storage battery in accordance with the requirements of the national standard. The automobile production enterprise shall record the corresponding information of the new energy vehicle and its power storage battery. Battery manufacturers and automobile manufacturers shall timely upload information on the battery code and new energy vehicles through the traceability information system.
Power batteries that are scrapped by battery manufacturers and automobile manufacturers in the production process shall be transferred to recycling service outlets or comprehensive utilization enterprises.
Article 10 An automobile manufacturing company shall entrust new energy vehicle salesmen to record the traceability information of new energy vehicles and all persons through the traceability information system, and specify the relevant information of the battery recovery requirements and procedures in the automobile user manual.
Article 11 An automobile manufacturing enterprise shall establish a maintenance service network to meet the maintenance needs of the owners of new energy vehicles and disclose technical information such as maintenance and replacement of power batteries to the public according to law. New energy automobile after-sales service agencies, battery leasing and other operating companies shall verify the information of owners of new energy vehicles when they are repaired, disassembled and replaced, and shall repair, disassemble and replace the power storage batteries in accordance with technical information requirements such as maintenance manuals and storage. Storage, transfer of used power storage batteries to recycling service outlets shall not be transferred to other units or individuals.
The operating companies such as new energy automobile after-sales service agencies and battery leasing companies should establish a dynamic link between the power battery code and new energy vehicles in the traceability information system.
Article 12 An automobile production enterprise shall establish a power battery recovery channel and be responsible for the recovery of used energy batteries generated after the use of new energy vehicles and after being scrapped.
(1) Automobile production enterprises shall set up recycling service outlets to collect used and used power storage batteries, store them centrally and transfer them to related companies that have agreements with them.
Recycling service outlets should follow the principle of facilitating transfer, collection, storage, and transportation, and comply with local urban planning and relevant regulations of the fire protection, environmental protection, and security departments, and indicate prompt information at prominent locations on business premises.
(2) Encourage automobile manufacturing enterprises, battery production enterprises, recycling and dismantling enterprises for scrapped automobiles, and comprehensive utilization enterprises to cooperate and jointly build and share waste power battery recovery channels through various forms.
(3) Encouraging auto manufacturers to adopt various methods to provide convenient and efficient recycling services for owners of new energy vehicles, and to increase their enthusiasm for the transfer of spent power batteries through measures such as repurchasing, trade-in replacement, and subsidies.
Article 13 Automobile manufacturing enterprises cooperate with scrap car recycling and dismantling enterprises, and share information on the dismantling and storage technologies of power batteries, recycling service outlets, and recycling of new energy vehicles. Recycling service outlets should track the recycling of new energy vehicles in the region. Recycling, repurchasing, and other methods can be used to collect the power batteries dismantled by the new energy vehicles.
The recycling and dismantling of scrapped new energy vehicles shall meet the requirements of the state's regulations, rules and standards for the recovery and dismantling of scrapped automobiles.
Article 14 When a new energy vehicle owner needs maintenance and replacement of the power battery, the new energy vehicle shall be sent to an after-sales service organization with appropriate capabilities to perform maintenance and replacement of the power battery; when the new energy vehicle reaches the scrapping requirement, it shall be delivered. Dismantling and dismantling enterprises to dismantle the power battery. The owner of the power battery (such as a battery rental company) shall transfer the used power battery to a recycling service outlet. Article 15 The collection of used power storage batteries may refer to the requirements of relevant national standards such as "Waste Oil Storage Recycling Management Regulations" (WB/T 1061-2016), and classify and identify waste power batteries according to the type of materials and the degree of danger. Article 16 The storage of used power storage batteries may refer to the "Pollution Control Policy for Waste Batteries" (Ministry of Environmental Protection Announcement No. 82 of 2016) and "Standard for Pollution Control of General Industrial Solid Waste Storage and Disposal Sites" (GB 18599-2016). Article 20: The enterprises that use ladders shall comply with the relevant national policies and standards and other requirements. Article 21 The use of battery products for ladders shall comply with the relevant national policies, standards, and other requirements, and shall not be used for the production or sale of battery products that do not meet the requirements of the ladder.
Article 22 Recycling enterprises shall follow the requirements of relevant national policies and standards, dismantle them in accordance with the dismantling technical information specifications provided by automobile manufacturers, and carry out recycling; and other non-utilizable residues after the recycling of waste power batteries, According to the national environmental protection regulations, policies and standards and other relevant provisions for environmentally friendly disposal.
Fourth, supervision and management
Article 23 The Ministry of Industry and Information Technology shall, together with the State Administration of Standardization, study and formulate technical standards for the recovery and utilization of power batteries such as demolition, packaging and transportation, residual energy detection, ladder utilization, material recovery, safety and environmental protection, and establish a management system for the recovery and utilization of power batteries. .
Article 24 To establish a point-upload system for power battery recycling service, automobile production enterprises shall regularly upload information such as power battery recycling service outlets through the traceability information system and publish relevant information to the public through the information platform.
Article 25 The Ministry of Industry and Information Technology and the General Administration of Quality Supervision, Inspection and Quarantine shall be responsible for the establishment of a unified traceability information system and shall establish information sharing mechanisms with the relevant departments such as the Ministry of Environmental Protection, the Ministry of Transport, and the Ministry of Commerce to ensure that the source of the battery products can be investigated and located. Article 28 The Ministry of Industry and Information Technology, in conjunction with the General Administration of Quality Supervision, Inspection and Quarantine, etc., shall, within the scope of their respective duties, order the enterprises to rectify and suspend the mandatory certification of enterprises within a limited time limit, disclose the information on the fulfillment of corporate responsibilities, declare the industry's regulatory conditions, and make public announcement management.
